DACA Deferred Action for Childhood Arrivals

Deferred Action for Childhood Arrivals (DACA) provides temporary protection from deportation and renewable work authorization for undocumented immigrants who arrived in the United States as children. While it does not create permanent status or a path to citizenship, DACA has enabled thousands to live, study, and work legally while building their futures.
- DACA remains active but limited in scope.
- Renewals: Current recipients may continue to renew every two years. Timely filing is critical to maintain protection and work authorization. File renewals 120–150 days before expiration to avoid gaps in work authorization and reduce risk.
- Initial Applications: New, first-time applications are not being processed due to ongoing legal challenges. Initial (first-time) DACA requests are accepted but not adjudicated.
- Advance Parole: Travel permits are still available in limited circumstances—educational, employment, or humanitarian reasons.
Acción Diferida para los Llegados en la Infancia (DACA) ofrece protección temporal contra la deportación y autorización de trabajo renovable para inmigrantes indocumentados que llegaron a Estados Unidos cuando eran niños. - Enrolled in school, graduated, earned a GED, or honorably served in the U.S. military
- No felony, significant misdemeanor, or multiple minor convictions

Legal Update / Actualización Legal (2025)
On January 17, 2025, the Fifth Circuit Court of Appeals ruled that major parts of the Biden Administration’s DACA rule are unlawful. (State of Texas, et al. v. United States).
- 🔹 Outside Texas: All other states, including Maryland, Virginia, and D.C., follow federal rules. Current recipients can renew and maintain work authorization. Renewals remain available nationwide while the case continues.
- 🔹 Inside Texas: Texas is the only exception. In Texas, DACA provides only protection from deportation for new recipients (no work authorization or driver’s licenses). Current DACA holders in Texas keep their existing valid work permits.
- USCIS is expected to issue updated guidance in response to this ruling.

- ⚠️ Important: Because of ongoing legal challenges, Advance Parole always carries risk. Even with approval, re-entry is not guaranteed. Speak with an experienced immigration attorney before traveling.
